Could one of your bike compensation solicitors please give me some advice? I was cycling to work on Monday morning when I had a bicycle accident. It was just after the big freeze and the roads were in a dreadful state. My front wheel hit a large pothole and I was propelled over the handlebars and landed on the roof of an escort van that was coming in the opposite direction.


Both my arms got caught and wedged in the roof rack of the van which I later learned had been stolen ten minutes previously and why the driver failed to stop. I was taken on a 30 minute, death defying and frightening journey through the streets of Birmingham as the driver weaved in and out of traffic, jumped read lights, drove the wrong way down one way streets and crossed the intersections of dual carriageways to avoid the police blocks. The van was eventually brought to a halt by the police laying stingers in the road and puncturing the tyres and the fourteen year old driver was arrested.

Once the police realised that I was not an accomplice acting as a lookout, they were extremely sympathetic. The driver of the police car that had been following said that they hadn’t realised I was caught on the roof rack; and my abusive language had not been directed at them or the general public but through my hysteria and pain. I really believe I have a case for bicycle accident claims against the driver.


Amazingly I only received a fractured right wrist and superficial bruising and grazes but I have been completely traumatised by the whole episode and unable to go out in traffic again since. I suppose I should count myself lucky because after the accident, when I went back to claim my bicycle, it had been completely crushed under the wheels of an oncoming dustcart. So, if I hadn’t landed on the roof of the van, it may have been me mangled under the wheels of the lorry.


So my question is; do I have a claim against my local council for failing to maintain the road and what steps can be taken against the fourteen year old driver for compensation. Incidentally, he has been arrested since for stealing a bus.
